WASHINGTON DC — On November 28 2025, Donald Trump declared that documents allegedly signed by Joe Biden using an autopen device are invalid. This includes executive orders, proclamations, and other official actions. Trump said that roughly 92 percent of Biden era documents were signed using the device rather than by Biden personally. He threatened perjury charges if Biden claims he authorized the signatures.
What Trump Is Claiming
• Trump said the documents include executive orders, memoranda, and potentially pardons. According to him, they were signed by staff using an autopen without Biden’s direct approval, which led Trump to void Biden autopen documents.
• Trump argued that because these signatures were not hand-signed by Biden, the documents are invalid. He vowed to cancel or rescind them.
• He warned that if Biden asserts he personally authorized or oversaw the autopen process, Biden should face perjury charges.
The Autopen History and Legal Background
The autopen is a mechanical device that reproduces a signature automatically. United States presidents have used autopen systems for decades. There’s a growing debate over Trump’s plan, which claims to void autopen documents approved by Biden.
While autopen use is common, presidents have used it for both routine and important documents. It has long been accepted as legally valid when used under the president’s authority.
A key 2005 memo from the Department of Justice Office of Legal Counsel stated that a president does not need to hand sign a bill for it to become law. This applies if proper authorization is given for the signature process.
Past presidents, including Donald Trump, have used autopens.
What This Could Mean
If Trump attempts to follow through on voiding all autopen signed documents, it would mean canceling those Biden autopen documents Trump has targeted.
• Hundreds of Biden era executive actions could be rescinded or paused. This includes rules on environmental policy, energy, social directives, and pardons.
• Legal challenges would likely begin immediately. Constitutional scholars have already stated that invalidating documents solely because of autopen use has no legal foundation.
• This could create widespread confusion for federal agencies and courts. They would need to determine what remains valid and what would need to be re-authorized.
Why This Looks More Political Than Legal
This move appears aimed at erasing a prior administration’s policies more than addressing a real constitutional issue. Trump has taken steps to void many of Biden’s documents signed via autopen.
Given the long accepted use of autopens under presidential authority, attempts to retroactively invalidate documents for that reason are unlikely to survive judicial review.
The larger concern is the instability this gesture unleashes across the administrative state. It could undermine public trust and create a precedent where each administration nullifies the work of the prior one based on technical claims.

Regardless of political preference, allowing any president to retroactively erase documents based on a decades-old signature practice undermines institutional stability. Government must run on law and continuity, or it becomes a tool of personal vendettas. The use of autopen technology was accepted across many administrations. Erasing documents simply because they were signed in a routine approved way threatens to replace order with chaos.
