While speaking to the Turning Point PAC in Duluth, Georgia, former presidential candidate Robert F. Kennedy Jr. claimed that the Biden/Harris administration had issued a directive to the Pentagon, changing the law to allow the U.S. military to use lethal force against American citizens on American soil. According to Kennedy, this directive would make it legal for the U.S. military to shoot and kill Americans engaged in political protest due to disagreement with White House policies. Kennedy made this statement after Vice President Harris gave a speech earlier in the day claiming that if elected, Trump would use the military against the American citizens.
The Department of Defense Directive 5240.01, issued on September 27, 2024, originated from the Office of the Under Secretary of Defense for Intelligence and Security and was approved by Deputy Secretary of Defense Kathleen H. The Posse Comitatus Act of 1878 was enacted in response to the military’s abuses and excessive use of force during the Civil War and Reconstruction era. The Act prohibits the U.S. military from engaging in domestic law enforcement activities. Many in the social media sphere now question whether the new Department of Defense directive allowing military involvement in certain civil matters conflicts with the Posse Comitatus Act’s core purpose of restraining military involvement in law enforcement on U.S. citizens. While no formal legal challenge or congressional inquiry has been initiated yet, the public attention on this directive may prompt pushback against perceived violations of the longstanding Posse Comitatus restrictions.
