The U.S. Supreme Court announced today that it will hear President Trump’s legal challenge to the modern interpretation of birthright citizenship. As a result, this sets up a major constitutional showdown in the Court’s 2025 term.

The justices agreed to review the case following lower court rulings that blocked enforcement of President Trump’s executive order titled Protecting the Meaning and Value of American Citizenship. Notably, the order, signed earlier this year, asserts that automatic citizenship under the Fourteenth Amendment does not apply to children born in the United States to parents who are in the country unlawfully or on temporary visas.
Lower Court Rulings Prompt High Court Review
According to reporting by Amy Howe of SCOTUSblog, the case places the long standing interpretation of the Citizenship Clause directly before the nation’s highest court for the first time in decades. Because lower courts had previously ruled that the executive order likely conflicted with established precedent, the Trump administration decided to seek Supreme Court review.
Official Court Order Released
In its official order list released today, the Supreme Court confirmed it will take up the issue during the current term. However, the Court did not immediately announce a date for oral arguments.

The outcome of the case could have far reaching consequences for federal immigration policy and the constitutional definition of citizenship. If the Court issues a ruling in favor of the administration, it could significantly alter how citizenship is conferred at birth.
