Jennie Taer of the Daily Wire broke the story yesterday that Radule Bojovic, an illegal alien from Montenegro, was reinstated to the Hanover Park Illinois Police Department after being detained by ICE and had a twenty five hundred dollar bail set by an immigration judge. The department stated in its press release that he was returned to full duty status and was awarded back pay for the time he spent in ICE detention.

But here is what is seemingly getting missed.

What the Law Actually Says

As an illegal alien under 18 U.S.C. § 922(g)(5), it is illegal for any person who is unlawfully in the United States to possess a firearm, possess ammunition or receive a firearm or ammunition. This is a felony offense and carries serious prison time.

This is not a judgment on Bojovic’s intentions or his willingness to serve. He may be the most sincere and noble person on the Hanover Park Police Department. I do not know him and I am not going to judge what is in his heart. That being said, we have laws for a reason and he does not qualify to carry a weapon in the United States, never mind be issued one by a police department.

Issuing a Firearm Is Also a Felony

It is also a felony under 18 U.S.C. § 922(d)(5) to provide a firearm or ammunition to someone known to be in the United States unlawfully. Which the department is surely aware of now even if they were not before.

So my question is simple. Will Bojovic be re arrested for being an illegal alien in possession of a firearm? And will anyone at the department who signed off and issued that weapon be arrested and charged as well?

Standards for Citizens But Not for This Case

There are American citizens in this country who are forbidden from carrying firearms because of a single non violent felony from decades ago under 18 U.S.C. § 922(g). So how can a city provide a firearm to a person who is knowingly illegal?

If the department wanted to prove a point, they could have chosen suspended with pay pending outcome of the federal case. Or modified duty. But full duty status?

You now have an illegal immigrant once again allowed to stop and detain an American citizen and potentially take their rights and even their life away under color of authority. This is a sacred responsibility. Those of us who worked in law enforcement were taught the gravity of that authority and how precious the rights of the citizens we served truly are.

Taxpayer Funded and Federally Supported

Never mind the fact that the Hanover Park Police Department receives funding from taxpayers at the local, state and federal levels. Federal tax dollars flow into the department at an estimated twenty five thousand dollars per year largely through federal highway safety enforcement grants with no comprehensive public accounting of total federal support.

Arrested by Someone Not Legally Authorized to Work

Imagine being a legal citizen who pays taxes and you forget to pay a speeding ticket and get arrested on a warrant by a man who does not even meet the minimal requirement to be a police officer under federal law. The legally authorized to work in the United States requirement.

You also have the reality that he is a walking felony if he is in possession of a firearm while unlawfully present.

Supporting Police Does Not Mean Ignoring the Law

I support law enforcement. I support cops. But I also support the Constitution and the laws of this country. And the law always comes before emotion.

I know people who were denied employment as police officers for checking the wrong boxes on an application or being behind on bills. That was deemed a risk to integrity and grounds for disqualification. But this situation gets a pass. Why?

Virtue signaling.

This Should Outrage Every Lawful Citizen

There are many stories that should make Americans angry. This one should be at the top of the list. You have a city so obsessed with being progressive that it spits in the face of every immigrant who did everything right to become a citizen and every taxpaying American in this nation.

Start prosecuting the brass. Start pulling federal grants and funding now.
