Senators Mark Kelly and Chris Van Hollen are raising alarm over the first Caribbean boat strike, calling it a possible war crime or even murder as new details emerge about a second strike on survivors.

Senator Mark Kelly and Senator Chris Van Hollen are now openly accusing the Biden administration of serious wrongdoing. They suggest it might be a war crime or outright murder in the first Caribbean boat strike. Their comments came after new reports claim the United States not only targeted a suspected drug-running vessel but may have ordered a follow-up strike on survivors who were no longer a threat.
Kelly spoke on CNN and stated that the available information raises serious concerns. He said the second strike on survivors “seems to” meet the definition of a war crime. He called for an Inspector General investigation. He wants public hearings to force the administration to explain who ordered the action. He also wants to know under what legal authority it was ordered.
Van Hollen took it even further in his interview. He argued that depending on the administration’s justification, the strike could be considered murder. He said if the legal rationale collapses, then there is no defense for the killing of people who were incapacitated, unarmed, and no longer posing a danger. Even if the administration’s first justification holds, Van Hollen said the follow-up strike still constitutes a war crime because it targeted people who could not fight back.
According to earlier reporting, the first strike hit a Venezuelan vessel suspected of drug smuggling. The allegation drawing the strongest backlash is that a second strike was ordered specifically to eliminate survivors. Lawmakers are focused on that detail. It is also the point that could expose the administration to massive legal and constitutional liabilities.
Law of Armed Conflict standards require that the United States distinguish between combatants and noncombatants. Survivors who are incapacitated are no longer lawful targets. If the reports are accurate, the action would violate long-standing rules on proportionality and necessity.
Kelly also warned that the United States cannot maintain moral standing in the world. This is especially true if it engages in operations that mirror tactics used by regimes we condemn. Van Hollen echoed this sentiment. He said the administration and the Pentagon must be held accountable if the investigation confirms the details.
