Supreme Court Justice Samuel Alito has issued a temporary administrative stay that pauses a lower court’s ruling blocking Texas from using its new 2025 congressional redistricting map in the 2026 elections. The order was issued Friday, November 21, 2025, and it keeps the Republican-drawn map in effect while the Supreme Court considers next steps.
The administrative stay does not signal how the Court will rule. It simply freezes the situation long enough for briefing and review.

Key Details
The Lower Court’s Ruling
On November 18, 2025, a three-judge federal panel in El Paso issued an injunction against Texas. The judges claimed there was “substantial evidence” that the 2025 map was an unconstitutional racial gerrymander designed to dilute minority voting power. They ordered Texas to revert to the 2021 map for the upcoming 2026 midterms.
Texas Files an Emergency Appeal
Texas Attorney General Ken Paxton responded immediately, filing an emergency request with the Supreme Court. Paxton asked for a stay on the injunction so the 2025 map could remain in use during litigation. Emergency applications from Texas go to Justice Alito because he handles matters from the Fifth Circuit.
Justice Alito’s Administrative Stay
Justice Alito granted a temporary pause. This does not address the merits. It simply prevents sudden electoral chaos while the Court reviews the filings. The stay keeps the 2025 map alive for now.
Next Steps
Justice Alito ordered the challengers of the Texas map to file their response by Monday, November 24, 2025. After that, either Alito or the full Supreme Court will decide whether to grant a full stay that would leave the 2025 map in place for the duration of the legal challenge.
This case could become one of the most consequential election-law fights of the cycle, with control of multiple congressional seats potentially hanging in the balance.
