Procedural Deadline at Center of Court Ruling
A federal judge has ordered the release of a self-admitted MS-13 member from U.S. Immigration and Customs Enforcement custody. She ruled that the agency failed to meet the required deadlines for his detention review.
Kilmar Rafael Abrego Garcia, 22, remained in ICE custody after multiple arrests in Maryland and statements to police acknowledging his ties to MS-13. Court records say U.S. District Judge Paula Xinis found that ICE missed the deadline to submit transcripts from a bond hearing. She ruled that the delay violated his due process rights and ordered his release.
ICE Warned of Public Safety Concerns
ICE objected to the ruling, arguing that Abrego Garcia posed a significant public safety risk. The agency cited his prior arrests and gang ties and asked to keep him in custody while his case moved forward. Judge Xinis noted in her order that the ruling was based on the procedural lapse rather than an assessment of the individual’s risk level.
Judge Orders Release Pending Ongoing Case
Local outlets reported that Abrego Garcia was released without electronic monitoring. The court order requires him to check in with ICE while the MS-13 member’s case continues. ICE filed an emergency motion to block the release, but the court denied the request.

Judge Xinis’s ruling has drawn responses from immigration officials and some lawmakers who say the case underscores long-standing concerns over ICE’s ability to meet court-imposed timelines in detention challenges. Supporters of the decision argue that the ruling reflects constitutional requirements placed on federal agencies during extended detention.
