A federal judge dismissed the Comey and Letitia James indictments after ruling the prosecutor lacked lawful authority.

A stunning federal court decision has thrown out the criminal indictments against former FBI Director James Comey and New York Attorney General Letitia James after the presiding judge ruled that the prosecutor who brought both cases had no lawful authority to do so.
The ruling centers on Lindsey Halligan, who had been installed as interim United States Attorney for the Eastern District of Virginia. Judge Cameron McGowan Currie determined that Halligan’s appointment violated federal vacancy rules, which strictly limit how and when interim prosecutors can be installed.
Because Halligan lacked proper legal authority, every indictment bearing her signature was declared invalid.
What the judge ruled
According to the decision:
- The previous interim appointment had expired after 120 days, which is the statutory limit.
- Because that deadline passed, the Attorney General no longer had the power to unilaterally appoint a successor.
- The proper constitutional process was not followed.
- Any indictment brought by an unlawfully appointed prosecutor is a legal nullity.
As a result, the indictments were dismissed without prejudice, meaning the government technically could refile charges. However, in Comey’s case, the statute of limitations may make that impossible.
What the cases involved
The Comey case
James Comey had been charged with:
- Making false statements to Congress
- Obstruction of a congressional proceeding
These charges stemmed from controversies tied to his tenure at the FBI.
The Letitia James case
Letitia James had been facing:
- Bank fraud allegations
- A mortgage related fraud scheme
These were based on alleged misrepresentations involving property financing.
Both sets of charges are now vacated due to the appointment issue, not due to the underlying evidence.
Why this matters
This ruling is a major setback for the Department of Justice. For months the political and legal world has watched these high profile cases unfold. Now both have been derailed because the prosecutor should not have been in office in the first place.
This raises several concerns:
- It exposes how fragile politically sensitive prosecutions become when internal DOJ procedures are not followed with absolute precision.
- It highlights structural tensions between the Attorney General and the courts in the appointment of interim United States Attorneys.
- It opens the door to possible challenges in other cases touched by Halligan or similar appointments.

Realistically, the DOJ faces two problems:

The issue of Halligan’s appointment could trigger reviews of any other actions taken during her invalid tenure.

Both Comey and James have been central players in long standing political battles. Critics of the prosecutions argued that the charges were politically driven. Supporters insisted they were long overdue.
Now the cases are not being judged on merit but on federal appointment procedures that should have been airtight from the beginning.
