WASHINGTON (Nov. 6, 2025) — The U.S. Supreme Court on Thursday cleared the way for the Trump administration to resume enforcing restrictions on passport gender markers, allowing the State Department to require that passports reflect only the sex listed on a person’s original birth certificate, according to NBC News.
The case, Orr v. Trump, appeared on the Court’s emergency docket. The unsigned 6-3 ruling lifts a lower-court order that had blocked the policy from taking effect, letting the administration move forward while litigation continues in the First Circuit Court of Appeals.
Reinstated earlier this year, the Trump-era rule removes the Biden administration’s 2021 “X” gender option and limits designations to “M” or “F.” Applicants must now present documentation confirming biological sex matches the requested marker, the Associated Press reported.
In June, U.S. District Judge Julia Kobick of Massachusetts ruled the policy likely violated the Constitution’s equal-protection clause, calling it “rooted in irrational prejudice toward transgender Americans,” according to Politico. The ruling had halted enforcement nationwide until the Supreme Court intervened.
The progressive justices dissented, with Justice Ketanji Brown Jackson writing that the order “will cause immediate harm to transgender and nonbinary people who rely on accurate identification for travel and safety.”
The ACLU, representing the lead plaintiff, called the order a setback but vowed to continue the challenge, arguing the restrictions are discriminatory and “arbitrary” under the Administrative Procedure Act.
Administration officials defended the policy as essential for “security and consistency in international identification standards.”
“Passports are legal documents, not personal expressions of identity,” said one senior official. “They must reflect verifiable biological facts.”
Civil-rights groups warn that reinstating the old rule could expose transgender travelers to increased scrutiny or delays, while supporters say the change restores clarity and integrity to official U.S. records.
The case now returns to the lower courts for further proceedings in the coming months.
