President Trump issued a sharp public response this morning after several Democrat lawmakers were recorded encouraging military personnel to refuse lawful orders, a story first reported by SHR Media on November 18. In a new post on Truth Social, Trump called the comments “seditious behavior at the highest level” and said anyone involved “should be arrested and put on trial.”
Is There A Crime?
Federal law outlines two statutes that apply when lawmakers or citizens attempt to undermine military authority or government stability.
18 U.S. Code § 2384 (Seditious Conspiracy)
This statute applies when two or more people agree to overthrow, oppose, or hinder the authority of the United States by force. It also covers efforts to prevent, delay, or stop the execution of federal law. Conviction carries a penalty of up to twenty years in prison.
18 U.S.C. § 2383 (Rebellion or Insurrection)
This section applies to anyone who incites, assists, or engages in rebellion against the authority or laws of the United States. It also covers giving aid or comfort to those who do. Conviction can result in fines, imprisonment for up to ten years, and disqualification from holding federal office.
