Rep. LaMonica McIver exits courthouse after judge denies dismissal of assault charges

Rep. LaMonica McIver suffered a major legal setback after a federal judge rejected her attempt to dismiss the charges. The motion to dismiss was denied, stemming from a confrontation with federal agents at a Newark detention facility earlier this year. The ruling ensures that McIver will now face trial on at least two federal counts and possibly a third once the judge finishes reviewing the final arguments.
According to the publicly posted decision signed by Judge Jamel K. Semper, McIver’s motion to dismiss was denied as she failed to convince the court that the charges should be thrown out. Her legal team argued that the incident fell under the protection of the Speech or Debate Clause. They also claimed the prosecution was politically motivated and selectively targeted. The judge rejected both arguments outright.
The confrontation occurred during a May oversight visit to the facility, where McIver allegedly shoved or struck a federal officer while attempting to enter a restricted area. The judge ruled that this physical interaction had nothing to do with legislative functions, which is why the motion to dismiss was denied, as it did not qualify for immunity. The ruling also stated that nothing presented in McIver’s filings supported a claim of selective or vindictive prosecution.
The court allowed two of the three counts to proceed immediately. The judge is still evaluating the third count but made clear in the written opinion that dismissal is unlikely without extraordinary evidence, which McIver has not provided, leading to her motion to dismiss being denied.
This ruling puts the congresswoman in a vulnerable position. Her public statements portray the case as partisan, yet the judge’s ruling directly contradicts that narrative. The court stated that the legal standards for immunity or selective prosecution simply were not met, leading to the motion to dismiss being denied. The charges will move forward regardless of political messaging.
McIver has signaled that she plans to appeal once the remaining count receives a final ruling. Until then the case will continue in federal district court, where prosecutors now have a clear green light to proceed.
